Unemployed complain they need a job to find a job

NEW YORK (AP) -- Help wanted. Qualifications: Must already have a job.

It's a frustrating catch for those out of work in an era of high unemployment: looking for a job, only to find that some employers don't want anyone who doesn't already have one.

But after four years of above-average joblessness in the U.S., efforts to bar such practices by employers have met with mixed results.

While New Jersey, Oregon and Washington, D.C., have passed laws making it illegal to discriminate against the unemployed, New York City's billionaire-businessman mayor vetoed on Friday what would have been the most aggressive such measure in the country. Similar proposals have stalled in more than a dozen other states and Congress.

Advocates for the unemployed say such hiring practices are unfair, particularly to those who have been laid off because of the economic crunch and not through any fault of their own. Businesses, though, say that the extent of such practices is exaggerated, hiring decisions are too complicated to legislate, and employers could end up defending themselves against dubious complaints.

Nationally, more than 1 in 3 unemployed workers has been looking for at least six months, according to the federal Bureau of Labor Statistics.

Janet Falk said that when she applied for a public-relations job at a New York law firm two years ago, the recruiter told her she wouldn't be considered because she had been out of work for more than three months. The recruiter was being paid to find candidates who were in jobs or just out of them.

"My personal view is that hiring is like musical chairs, and if only the people who are already on the dance floor are playing, then the long-term unemployed can't get in the game," said Falk, who was laid off four years ago. She now runs her own consulting business.

An October 2011 search of New York City-based job listings found more than a dozen that explicitly required candidates to be employed, Manhattan Borough President Scott Stringer's office said. A broader review that year by the National Employment Law Project found 150 ads that were restricted to or aimed at people currently working.

As for why, experts say employers may think that unemployed applicants' skills have atrophied, that they lost their jobs because of their own shortcomings, or that they will jump at any job offer and then leave as soon as something better comes along.

But "'don't apply, don't even try' is the opposite of American values," New York City Council Speaker Christine Quinn said when the measure passed last month. She said Friday that she expects the City Council will override Mayor Michael Bloomberg's veto within a month.

Bloomberg called the measure a well-intended but misguided effort that would create more lawsuits than jobs.

"Hiring decisions frequently involve the exercise of independent, subjective judgment about a prospective employee's likely future performance," he said in a statement.

And unlike other characteristics that employers are generally banned from considering, such as an applicant's race, religion or gender, "the circumstances surrounding a person's unemployment status may, in certain situations, be relevant to employers when selecting qualified employees," he said.

Business groups say that no-unemployed-applicants-need-apply ads represent a tiny fraction of the millions of job openings nationwide each year.

One 2011 listing that got city lawmakers' attention ? it required that applicants for an opening as a New York legal secretary "must be currently employed" ? was mistakenly written that way, said William Alcott, a lawyer for the firm that posted it, McGuireWoods LLP.

"It was not our policy then and isn't our policy now," he said this week.

Like other measures that have passed, the New York City one would ban help-wanted ads that say unemployed applicants won't qualify. It would also more generally prohibit employers from refusing to hire candidates because they are out of work.

But New York's measure would go further than the others by letting rejected applicants sue employers for damages.

Companies see it as government meddling and "creating another basis for unmerited lawsuits against employers," said Kathryn Wylde, president of the Partnership for New York City, an influential business group.

President Barack Obama proposed in 2011 to make it illegal to refuse to consider unemployed applicants.

New Jersey in 2011 became the first state to outlaw the practice. The state Labor Department has gotten one complaint so far and cited a company for an ad that excluded jobless applicants; the case is not yet resolved, the agency said this week.

Oregon and the District of Columbia followed suit last year, while 15 other states considered similar proposals, according to the National Conference of State Legislatures. Gov. Jerry Brown vetoed such a measure in California last fall, indicating he wasn't happy with changes made to it.

Zendesk security breach affects Twitter, Tumblr and Pinterest

Customer service software provider Zendesk announced a security breach that allowed attackers into its system, where they could access data from three customers this week. Wired learned those three clients were Twitter, Pinterest and Tumblr.

The San Francisco-based company announced the breach in a blog post published early Thursday night. Tumblr notified affected users in an email at approximately 6:35 p.m. PST; Twitter and Pinterest are expected to do so shortly. Zendesk declined to comment beyond its blog post, titled, appropriately, ?We?ve been hacked.? The post reads in part:

We?ve become aware that a hacker accessed our system this week. As soon as we learned of the attack, we patched the vulnerability and closed the access that the hacker had. Our ongoing investigation indicates that the hacker had access to the support information that three of our customers store on our system. We believe that the hacker downloaded email addresses of users who contacted those three customers for support, as well as support email subject lines. We notified our affected customers immediately and are working with them to assist in their response.

Zendesk allows companies to outsource many of their customer service functions to it via software tools. It has more than 25,000 clients, according to its website.

Zendesk noted that a hacker downloaded e-mail addresses of users who contacted those three customers for support, along with the e-mail subject lines. Wired?s source claims some customers also may have had their phone numbers revealed, but no passwords, password hashes, or even encrypted passwords were revealed. Neither Twitter, Pinterest nor Tumblr are aware of any user accounts that were compromised by the attack.

The e-mail sent by Tumblr states:

Annie Leibovitz: Pilgrimage Exhibit in Santa Fe, New Mexico

Currently housed in Santa Fe, New Mexico at The Georgia O?Keeffe Museum and established by the Smithsonian American Art Museum, Annie Leibovitz: Pilgrimage Exhibit portrays a fresh outlook for one of America?s best-known living photographers.? Recognized for staged and cautiously lit portraits for Rolling Stones and Vanity Fair, Leibovitz?s Pilgrimage Exhibit displays images that were taken modestly due to her connection with the subjects.?

Leibovitz traveled to Santa Fe and Abiquiu a handful of times to photograph Georgia O?Keeffe?s home and countryside at the famed Ghost Ranch.? Leibovitz also visited to capture O?Keeffe?s Black Place, in the Santa Fe Museum?s vault.?

While not containing people, the photographs in Leibovit?s Santa Fe exhibit have molded the viewpoint of cultural inheritance, hence the title.? Visiting the homes of iconic figures, including O?Keeffe?s, she acceptable her intuitions and perceptions to lead her to connecting focuses.? Her photographs express curiosity of the world by spanning landscapes, interiors, and objects that are amulets of historical existences.?

Sponsored by local business and hotels, including The Inn and Spa at Loretto, this Santa Fe exhibit celebrates the current O?Keeffe display Faraway: Nature and Image, which contains artifacts of O?Keeffe?s cherished Southwest landscapes.

This exhibit is organized by The Smithsonian American Art Museum.? The Georgia O?Keeffe Museum is the fourth stop on a national tour of this exhibition.? HP Q1 2013 earnings: $1.2 billion in profit on revenue of $28.4 billion

HP's stock is climbing in after hours trading from news of the company's quarterly financial results. The Palo Alto firm has posted a profit of $1.2 billion for the first quarter, which is based on revenues of $28.4 billion. While the results fared better than HP's previous expectations, both profit and revenue have fallen year-over-year for the Silicon Valley mainstay, down 16 percent and six percent, respectively. With respect to the company's divisions, personal systems, printing, enterprise, services and software have each taken a hit from the previous year, with HP's financial services segment being the only unit to show growth (despite the fact that financing volume is also down). Beyond the sagging numbers, Meg Whitman is offering reason for optimism to investors, saying the company will bring "a number of new programs and disruptive innovations to market in the coming quarters, and we expect the benefits from our restructuring will accelerate through fiscal 2013." Cornell scientists 3D print ears with help from rat tails and cow ears

Science! A team of bioengineers and physicians over at Cornell University recently detailed their work to 3D print lifelike ears that may be used to treat birth defects like microtia and assist those who have lost or damaged an ear due to an accident or cancer. The product, which is, "practically identical to the human ear," according to the school, was created using 3D printing and gels made from living cells -- collagen was gathered from rat tails and cartilage cells were taken from cow's ears. The whole process is quite quick, according to associate professor Lawrence Bonassar, who co-authored the report on the matter,

"It takes half a day to design the mold, a day or so to print it, 30 minutes to inject the gel, and we can remove the ear 15 minutes later. We trim the ear and then let it culture for several days in nourishing cell culture media before it is implanted."

The team is looking to implant the first ear in around three years, if all goes well.

(AP) ? Passengers finally escaped the disabled Carnival cruise ship Triumph and were on the move Friday: some checked into hotels while others hopped on buses or jumped on charter flights home after five numbing days at sea on a cruise liner paralyzed by an engine-room fire.

The vacation ship carrying some 4,200 people docked late Thursday in Mobile to raucous cheers from passengers weary of overflowing toilets, food shortages and foul odors.

"Sweet Home Alabama!" read one of the homemade signs passengers affixed alongside the 14-story ship as many celebrated along deck rails lining several levels of the stricken ship. The ship's horn blasted several times as four tugboats helped it to shore at about 9:15 p.m. CST. Some gave a thumbs-up sign and flashes from cameras and cellphones lit the night.

"It was horrible, just horrible" said Maria Hernandez, 28, of Angleton, Texas, tears welling in her eyes as she talked about waking up to smoke in her lower-level room Sunday from the engine-room fire and the days of heat and stench that followed. She was on a "girls trip" with friends.

It took about four hours for all passengers to disembark.

Carnival spokesman Vance Gulliksen said passengers had three options: take a bus straight to Galveston, Texas, to retrieve cars parked at the ship's departure port, take a bus to New Orleans to stay at a hotel before a charter flight home or have family or friends pick them up in Mobile.

As if the passengers hadn't endured enough, one of the buses broke down during the two-hour ride to New Orleans. Carnival spokesman Vance Gulliksen said the passengers got on another bus and made it safely to New Orleans.

Gulliksen said up to 20 charter flights would leave New Orleans later Friday to take guests who stayed in hotels there to their final destinations.

Nearly 2,000 passengers arrived at a New Orleans Hilton in the wee hours, and by dawn many were headed out again to fly to Houston. They then had to get a connecting flight home or chartered bus back to their cars in Galveston.

"It just feels so good to be on land again and to feel like I have options," said Tracey Farmer of Tulsa, Okla. "I'm just ready to see my family. It's been harder on them than us I think because they've been so worried about us. It's been extremely stressful for them."

Buses arrived at the Port of Galveston on Friday morning after an eight-hour drive from Mobile. Port of Galveston police said they expected as many as 800 people by bus.

Some people faced a long drive home once they arrived in Galveston.

"It's going to be a very long day," said Dwayne McAbee, who had a six- to seven-hour drive from Galveston to his home in Fort Worth, Texas.

In Mobile, tugs pulled the ship away from the dock Friday, moving it down a waterway in the direction of a shipyard where city officials said it will be repaired. Gulliksen said the damage assessment was ongoing and the company did yet have a timetable for the repairs. Several cranes were stationed alongside the ship and smoke could be seen spewing from its generators.

Only hours earlier, weary passengers streamed down the gangplank, some in wheelchair.

For 24-year-old Brittany Ferguson, of Texas, the worst part was not knowing how long they would be at sea.

"I'm feeling awesome just to see land and buildings," said Ferguson, who was in a white robe to keep her warm during cold nights.

As the ship pulled up, some aboard shouted, "Hello, Mobile!" Some danced. "Happy V-Day" read one of the homemade signs made for the Valentine's Day arrival and another, more starkly: "The ship's afloat, so is the sewage."

A line of taxis waited for people, and motorists on Interstate 10 stopped to watch the exodus of passengers. Some still aboard chanted, "Let me off, let me off!"

It took six grueling hours navigating the 30-mile ship channel. At nearly 900 feet in length, it was the largest cruise ship ever to dock at Mobile.

Galveston is the home port of the ill-fated ship, which lost power in an engine-room fire Sunday some 150 miles off Mexico's Yucatan peninsula.

A team of six investigators from the National Transportation Safety Board was in Mobile to look into what caused the engine room fire, NTSB spokesman Keith Holloway said Friday.

The NTSB was working with the U.S. Coast Guard and the Bahamas Maritime Authority, which will serve as the primary investigative agency. The Bahamian government was taking the lead because the Triumph is a Bahamian-flagged vessel and it was in international waters at the time of the fire, Holloway said.

Still, the NTSB could take information from the probe and use it to make recommendations for improving cruise ship safety, he said.

Carnival CEO Gerry Cahill apologized at a news conference and later on the public address system as people disembarked.

"I appreciate the patience of our guests and their ability to cope with the situation. And I'd like to reiterate the apology I made earlier. I know the conditions on board were very poor," he said. "We pride ourselves on providing our guests with a great vacation experience, and clearly we failed in this particular case."

Joseph and Cecilia Alvarez of San Antonio said some passengers passed the time by forming a Bible study group.

"It was awesome," he said. "It lifted up our souls and gave us hope that we would get back."

The company disputed the accounts of passengers who described the ship as filthy, saying employees were doing everything to ensure people were comfortable.

In a text message, Kalin Hill, of Houston, described deplorable conditions over the past few days.

"The lower floors had it the worst, the floors 'squish' when you walk and lots of the lower rooms have flooding from above floors," Hill wrote. "Half the bachelorette party was on two; the smell down there literally chokes you and hurts your eyes."

Passengers were supposed to get a full refund and discounts on future cruises, and Carnival said it would give an additional $500 in compensation.

"This is my first and last cruise. So if anyone wants my free cruise, look me up," said Kendall Jenkins, 24, of Houston. Bounding off the ship in bathrobes, she and her friend Brittany Ferguson immediately kissed the pavement at the Port of Mobile in Alabama.

Lease? Or buy? It?s always a tough question for residents in the Carson City area. But here are a few ideas that?ll make the choice more clear.

Either option gives you a choice of how you might finance your car. If you buy, you?ll pay the full cost of the car, with maybe an initial down payment, then monthly payments on the balance that pays down the loan principal, and the finance charge.

Remember, you have to return your leased vehicle in excellent condition, and may need to do all manufacturer?s recommended service and maintenance, or face penalties. So see your local Carson City service center on a regular basis, get the required work done and save the service records. It?s well worth it.

Source: AMR, US Airways delay meeting on merger

(AP) ? The boards of American Airlines parent AMR Corp. and US Airways have pushed back meetings to consider final plans for their merger, Associated Press sources say.

A source close to the matter said Sunday that the AMR board wants to meet in person, and that the US Airways board would only meet after the AMR board approves a deal. The source requested anonymity because the talks are private.

It is not clear when the two boards would finally meet. People familiar with the matter said negotiations are continuing, on issues that include AMR CEO Tom Horton's exact title and role in the combined company.

Discussions were centered on Horton being a non-executive chairman of the board while US Airways management, led by CEO Doug Parker, would run the day-to-day operations of the new carrier, which would keep the American Airlines name.

The negotiations could still fall apart. United Airlines and Continental Airlines were within days of announcing a merger in 2008 when that deal fell apart, although they later resumed talks and completed a deal in 2010.

If American and US Airways combine, it would create the world's biggest airline as measured by passenger traffic, although United Continental Holdings Inc. would still be slightly bigger if regional operations such as United Express and American Eagle are counted.

On Friday, US Airways pilots ratified an agreement covering their pay and working terms if there is a merger. That was the last major piece to fall into place on the labor side for a merger to occur. American Airlines pilots approved a similar agreement in December. All three of American's unions support a merger that would result in US Airways management running the new company.

The committee representing unsecured creditors in AMR's bankruptcy case had planned to meet Monday.

In the United States childhood obesity is a constant and growing problem; something that has astounded and baffled professionals from every corner of the map. Of course it does not help that just about anything sold in the US that is a sweet liquid contains copious amounts of high fructose corn syrup. That, though, is an issue best left for another day. What makes childhood obesity sad is that the kids who suffer from it seem like they haven?t been given a fair shot at life and that?s terrible. In addition to the bullying they have to endure from their peers, the kids also suffer from a variety of physical problems ranging from back pain and arthritis to Type II diabetes. There is much more to this sad state of affairs, and we will mention just a few in this article.

Type II diabetes is a major problem and is a serious probability for kids, teens and adults who are obese. Of course, it does make a certain sum of sense that it might happen. This particular kind of diabetes is different from Type I in that it can be prevented in some cases. Primary risk factors for this kind of diabetes are weight issues like obesity and a prolonged sedentariness. People who are obese have more strain put on their bodies to produce insulin. There is obviously an much greater amount that has to receive it. Over time the body becomes more and more resistant to the insulin it produces and that is when Type II diabetes happens.

Just about any person who is obese suffers from a litany of psychological challenges. When a child feels like he is under constant abuse from peers he is more likely to hate himself, not have any self confidence and have severe stress and anxiety issues. Those are all silent symptoms that obese children and teenagers endure and often without any help. After the situation has progressed enough and over enough time that person might develop sociopathic behaviors. We can?t find any honest data about the number of obese high school students who end up going to college. We?re willing to bet that there are a lot more obese high school students than college students. Who can blame them, though, when they may be thinking about four more years of torture and abuse. There are a few reasons as to why the prospects do not seem very clear for an obese child. When an obese child becomes an adult there is a long list of health problems and diseases that are at risk of. What about being able to reverse this condition?

Well, studies show that obese teenagers are sixteen times more prone to developing into severely obese adults. This is very clearly not boding well for those teens. Since the risk factors are actually developing when they are young, they are looking at a severely diminished quality of life as an adult. Early onset obesity is a real problem that affects even those who do not suffer from it. It is important to look at this also from the standpoint of cost to society. Obese kids will usually become obese adults, and there are costs associated with medical, lost time from work, etc. So this really is a social problem even though that is not at the forefront of awareness.
