Mind Body Spirit Odyssey: Terrain - Garden Paradise on a Winter Day


For people who love to garden, the process doesn't stop just because it is cold outside.? It just shifts - inside.? Outside the soil freezes, the bare bones of our trees and shrubs are exposed.? We survey and contemplate what is underneath, taking stock of what we need to change and improve upon to make the garden function better in the Spring.


People also undergo an internal process during the winter months.? According to the Tao, we turn inward along with the season.? Contemplating...connecting with the energy of the North, with our inner thoughts and process.? We find ourselves evaluating, re-evaluating, throwing out what doesn't work or what we don't need any more...making quiet plans.? Winter has a way of doing that naturally to people.? Especially when the weather limits your activity.? It's your resting time, courtesy of natural law.? How you choose to handle it of course, is up to you.? Many people throw themselves into a regime of strenuous fitness and exercise.? That's not what it's suppose to be about.? But neither is three months vegging away on the couch in front of the TV either.

Anyway...I digress.

In winter I usually find myself in quiet mode.? Not terribly creative, but contemplative...definitely on the introspective side of the creative wheel.? I write more, I re-organize and re-think what I have done over the last year, eventually pulling together a (usually pretty vague) vision of what direction my path should take during the new calender year.

During this process I'm usually not only thinking about my artwork and jewelry designs, but also thinking about my garden.? The garden may be cold and bare boned outside, but inside I still crave nurturing the green and enjoying the beautiful colors displayed by the plants when they are in boom.

On a recent trip to Philadelphia, my son suggested we visit a garden shop/restaurant that he discovered not too long ago.? He told me that it was a amazingly beautiful place that I just had to see...and boy he certainly did not exaggerate!? Terrain is probably one of the most unique, gorgeous indoor retail spaces that I have ever been in - period.? It's a close second to ABC Carpet, and that's saying a lot!

Terrain is owned by Urban Outfitters, so right away you know it's going to have an edge and aesthetic appeal that you are not going to find every day.? The indoor garden shop is truly a glowing visual and sensory experience.? The space also extends into a wonderful little restaurant, specializing in locally sourced and prepared artisan food.? It was such an incredible environment.? I honestly could have moved in and stayed forever.

Philadelphia is Terrain's flagship store, and it only has one other location in Westport, Connecticut.? I've read articles where the store may be an attempt to target gardening and outdoor living to more of a Gen Xer audience, probably given the parent company, but I find that generalization to be pretty short sighted.? What is does offer is a wonderful opportunity to introduce the people of all ages to the visual aesthetic and artistic beauty of horticulture and garden design - an experience much different then just shopping for plants in the garden section of the Home Depot.

In addition to gardening supplies, I should also mention that the store beautifully integrates a whole range of books on food and gardening, artisan bath and body products, a sprinkling of furniture, lighting, curios and other carefully placed interior odds and ends into their space.? There is also an entire outdoor section of the shop which was closed for the winter.

So, if your thoughts are turning to the garden - even though it may be snowing - maybe you will get some ideas from some of these photos for some things you can be doing in your own home to pass the winter months.

If you do not live near Philadelphia or Westport, you can also visit Terrain's online store, where you will find a nice selection of some of the items available in their shop.

I'll close by saying, I really do hope that this is one retail store that will have greater availability to more people in the future.? It was definitely an uplifting experience for the Mind, Body and Spirit.

Hubble focuses on the 'Great Attractor'

Jan. 22, 2013 ? A busy patch of space has been captured in an image from the NASA/ESA Hubble Space Telescope. Scattered with many nearby stars, the field also has numerous galaxies in the background.

Located on the border of Triangulum Australe (The Southern Triangle) and Norma (The Carpenter's Square), this field covers part of the Norma Cluster (Abell 3627) as well as a dense area of our own galaxy, the Milky Way.

The Norma Cluster is the closest massive galaxy cluster to the Milky Way, and lies about 220 million light-years away. The enormous mass concentrated here, and the consequent gravitational attraction, mean that this region of space is known to astronomers as the Great Attractor, and it dominates our region of the Universe.

The largest galaxy visible in this image is ESO 137-002, a spiral galaxy seen edge on. In this image from Hubble, we see large regions of dust across the galaxy's bulge. What we do not see here is the tail of glowing X-rays that has been observed extending out of the galaxy -- but which is invisible to an optical telescope like Hubble.

Observing the Great Attractor is difficult at optical wavelengths. The plane of the Milky Way -- responsible for the numerous bright stars in this image -- both outshines (with stars) and obscures (with dust) many of the objects behind it. There are some tricks for seeing through this -- infrared or radio observations, for instance -- but the region behind the center of the Milky Way, where the dust is thickest, remains an almost complete mystery to astronomers.

This image consists of exposures in blue and infrared light taken by Hubble's Advanced Camera for Surveys.

(AP) ? The intention to turn a St. Petersburg clinic treating pediatric cancer patients into one that would exclusively serve judges and staff of Russia's highest courts spread widespread public dismay.

More than 100,000 people signed a petition to President Vladimir Putin, a city native, urging him to scrap the plan to change City Hospital No. 31. Among those who signed were prominent figures from the worlds of art and sciences, including physicist Zhores Alfyorov, a Nobel Prize winner who is a member of Russia's parliament.

In a rare occasion of what appears to be the government bowing to public pressure, the plan was shelved Wednesday.

The St. Petersburg governor's office said the hospital would continue to treat patients and insisted there was no plan to change its location or profile when the Supreme Court and other top courts are relocated to Russia's second largest city from Moscow.

The Kremlin's property department also issued assurances that the hospital, located on prestigious Krestovsky Island, would not be given over to judges of the top courts.

Even so, about 1,500 people took part in a planned evening protest, with some saying they did not trust officials not to go back on their word. Braving a bitter winter wind, they held up signs that said: "Children are more important than bureaucrats" and "You want to kill the hospital, but you will kill children instead."

"Even a one-day break in the work of the hospital is a potential murder," said protester Anna Ivanova, a 29-year-old pediatrician who trained with the hospital's doctors.

"I'm sure that it is only the fact that people have come out to defend the hospital that it might be saved," said Nadezhda Dankova, a 32-year-old pediatric nurse.

Yelena Grachyova, coordinator of a charity foundation that helps children and adults suffering from cancer, said the timing of the government's about-turn was clearly aimed at thwarting the protest rally, which organizers had hoped would attract thousands. Grachyova said there had been previous attempts to take over the hospital because of the prime real estate it occupies, and she called for legal guarantees protecting it and other hospitals and schools on city property.

Other unpopular projects in St. Petersburg also have been scuttled or changed in recent years in the face of public opposition. In 2010, Gazprom was forced to abandon plans to build a glass skyscraper in the city's historical center.

Putin, however, has generally ignored opposition demands and avoided giving any ground on controversial issues, apparently seeing it as a sign of weakness. His decision last month to sign a bill banning Americans from adopting Russian children came despite widespread public outrage.

Putin has not weighed in on the hospital controversy.

In Soviet times, Hospital No. 31 provided medical treatment for privileged Soviet bureaucrats. Similar specialized clinics for the Communist Party elite existed elsewhere as well.

During the democratic reforms of the 1980s, the hospital was handed over to the city, with preference to be given to World War II veterans. The children's oncology clinic also was established.

"Twenty years ago it seemed obvious that the privileged St. Petersburg residents were precisely children and elderly people. We hope this is not in doubt now," the petition to Putin says.

Moscow has numerous hospitals that serve the presidential administration or a certain government ministry, a tradition carried down from Soviet times. Today, however, the medical services also are available to other residents on a paid basis.

Microsoft Has No Business Selling Tablets: Josh ... - Yahoo! Finance

Microsoft (MSFT) announced Monday it will begin selling its Surface Pro tablets to consumers on Feb. 9.

The Surface Pro tablet will retail for $899. It offers a faster processor and greater power than its sister Surface RT tablet (which sells for half the price). Microsoft entered the tablet market in October 2012 ? about 2.5 years after Apple (AAPL) debuted its iPad.

Microsoft will report sales of its tablets on Thursday when the Seattle-based company releases fourth-quarter earnings. According to Wall Street estimates, sales may be lackluster.

UBS analyst Brent Thill told The New York Times he slashed his Q4 Surface sales forecast by half; he?s now expecting sales to total 1 million, down from 2 million. In comparison, Apple reported last November that it sold 3 million fourth-generation iPads in three days after the product?s launch.

Microsoft definitely faces an uphill battle in the tablet market. Consumers can choose from a diverse array of tablets including Barnes & Noble?s (BKS) Nook, Amazon?s (AMZN) Kindle, the HP (HPQ) Envy, the Archos 101 G9, Acer Iconia Tab, Samsung Galaxy, Blackberry Playbook (RIMM) and the Google (GOOG) Nexus 7.

Josh Brown, vice president of Fusion Analytics and author of the widely read ?The Reformed Broker? blog, says Microsoft has no business being in the hardware business.

?The public is not clamoring for a Microsoft products,? he says in an interview with The Daily Ticker. ?I don?t know if the Surface launch accomplished anything other than ?hey we?re in this business now.??

Brown advises against owning shares of Microsoft and says only a leadership change at the upper echelon of the Microsoft corporate ladder ? including the departure of CEO Steve Ballmer ? would be the catalyst to push the stock higher.

Reports that Microsoft may provide capital for a deal that would take computer maker Dell (DELL) private could be seen as a veiled attempt by Microsoft to boost sales of its Windows operating platform. Dell has been a long-time partner and supporter of Microsoft as well as an important source of Microsoft?s profits.

Global jobless to hit record 200 million this year: ILO

GENEVA (Reuters) - The global jobless queue will stretch to more than 200 million people this year, the International Labour Organization said in its annual report on Tuesday, repeating a warning it has made at the start of each of the last six years.

The U.N. jobs watchdog estimates unemployment will rise by 5.1 million this year to more than 202 million, and by another 3 million in 2014, following a rise of 4.2 million in 2012.

If those predictions are right, global unemployment will hit a record. But the ILO has revised its jobless figures down each year as the number of those giving up the job hunt altogether swells, meaning they are no longer classed as unemployed.

A Reuters analysis of previous ILO reports shows that estimates of unemployment made in each of the last six years have subsequently been cut. The original 2007 joblessness figure of 189.9 million is now put at 169.0 million - 11 percent lower.

Figures for 2008-2010 have also fallen by 10-15 million from the original estimates.

Most of the drop is due to people giving up looking for work, said Jose Manuel Salazar-Xirinachs, head of director of labour market analysis at the Geneva-based ILO.

"These are people who, because of the seriousness of the crisis, because of long-term unemployment, have given up hope, have decided to not search for work any more, and therefore they are not counted as unemployed but more as discouraged," he said.

The ILO's revised figures mean global unemployment has risen by 28 million since 2007, before the start of the financial crisis, said ILO Director-General Guy Ryder.

With a further 39 million "discouraged" people withdrawing from the labour market over the same period, the crisis could be seen to have created a global jobs gap of 67 million, he said.

However, despite the greater number people believed to have given up on looking for work, the ILO's latest report did not revise figures given a year ago for the total number of people in the labour market.

The so-called "labour force participation rate", which measures the proportion of the working-age population who are working or looking for work, is thought to have remained steady at 64.1 percent for the past three years, showing no sign of the labour force shrinking.

The figure had been above 65 percent until 2007 but fell in each of the subsequent three years.

Latest inaugural forecast: Bit warmer than in 2009

WASHINGTON (AP) ? Consider it the first fact check of a Barack Obama campaign pledge for his second term: Will he, or Mother Nature, deliver on promised warmer Inauguration Day weather?

It's shaping up as a close call.

In September, while campaigning in Colorado, Obama was talking to a potential voter who mentioned he had been one of the hundreds of thousands of people outdoors at Obama's bone-chilling first inaugural in 2009, when the noontime temperature was 28 degrees. Obama promised: "This one is going to be warmer."

Scientifically, the president can't control the weather of course. Still, it's a promise that for a long time looked close to a sure thing with the average high on Jan. 21 being about 43 degrees.

An Arctic cold front looks to be racing toward the mid-Atlantic, so it will be slightly cooler than normal on Monday ? and with a chance of snow ? but not as cold as it was in 2009. Look for highs around 40 degrees with noon temperatures in the mid- to upper 30s. That would keep Obama's pledge.

There's also a 40 percent chance of scattered snow showers. But the Arctic cold front won't arrive until Monday night into Tuesday.

Extreme cold on Inauguration Day, folklore says, can be a killer.

In 1841, newly elected president William Henry Harrison stood outside without a coat or hat as he spoke for an hour and 40 minutes. He caught a cold that day and it became pneumonia and he died one month after being sworn in.

Twelve years later, outgoing first lady Abigail Fillmore got sick after sitting outside on a cold wet platform as Franklin Pierce was inaugurated and she died of pneumonia at the end of the month. Doctors now know that pneumonia is caused by germs, but prolonged exposure to extreme cold weather may hurt the airways and make someone more susceptible to getting sick.

India political heir Rahul Gandhi condemns elitism

JAIPUR, India (AP) ? Rahul Gandhi, the heir to India's Nehru-Gandhi political dynasty, said Sunday he would work to transform the country by decentralizing power after he was elevated to the governing Congress party's No. 2 post.

His career is the ultimate expression of Congress' reliance on the Gandhi family name, but the man widely expected to be the party's candidate for prime minister in next year's elections on Sunday condemned elitism as "the tragedy of India" and vowed to work to expand access to power for ordinary people.

"For me, the Congress party is my life. The people of India are my life and I will fight for them," Gandhi, a 42-year-old lawmaker, said in his acceptance speech Sunday in the western Indian city of Jaipur, a day after he was appointed the party vice president, a position behind his mother Sonia Gandhi, who is the Congress party president.

Reflecting on his eight years while working for the party organization, Rahul Ganhi said India's governmental system was struck in the past and the answer lay in completely transforming it.

"A handful of people control the entire political space. We don't respect knowledge, We respect position," he said to cheering party workers.

"If you don't have position, you have nothing. That's the tragedy of India," he said.

Rahul Gandhi also said many Indian youths are angry because they have been excluded from the political class.

"We only empower people at the top of the system. We don't believe in empowering all the way to the bottom," he said.

However, opposition parties are already seizing on the fast political rise of Rahul Gandhi ? the son, grandson and great-grandson of Indian prime ministers ? to brand Congress as nepotistic and elitist.

Arun Jaitley, a leader of the opposition Bharatiya Janata Party, said Rahul Gandhi's elevation in the Congress party was a move to convert the world's largest democracy into a dynastic one. Jaitley said the leader of his party was decided on the basis of ability, not lineage.

In 2004, Manmohan Singh, a technocrat, was chosen to fill the prime minister's seat in 2004 by Sonia Gandhi, the Congress leader and widow of assassinated Indian Prime Minister Rajiv Gandhi.

Singh has been widely seen as a regent, keeping the seat warm until Rahul Gandhi was ready to take what some see as his birthright.

But Gandhi has displayed little public sign that he is undergoing any sort of apprenticeship that would prepare him for running the country. He has never held a Cabinet-level position.

Party workers have been demanding Rahul Gandhi's elevation for years, but he had been shying away from holding a top position in the party.

His supporters argued he was rebuilding the party at the grassroots level and has taken a lead in the Congress' campaigns in state elections in Uttar Pradesh and in Bihar in recent years. The party performed poorly in both states' elections last year.

Rahul Gandhi entered politics in 2004 and became a lawmaker from Amethi seat in northern Uttar Pradesh state. The parliamentary seat was held by his mother until she shifted to a neighboring constituency.

According to Derrick Goold of the St. Louis Post-Dispatch, Cardinals great Stan Musial died in St. Louis at 5:45 p.m. local time on Saturday evening. Goold says Musial was ?surrounded by family? when he passed.

?Stan The Man? ? a picture of poise, grace and consistency ? tallied 1,815 hits at home and 1,815 on the road over the course of his 22-year major league career. The lifetime Cardinal won three World Series titles, three National League MVPs and was a first-ballot inductee into the Baseball Hall of Fame in 1969.

He has a statue outside Busch Stadium and his No. 6 was retired by the Cardinals in 1963 ? the same year that he stopped playing. He was given the Presidential Medal of Freedom ? the highest honor that the United States?government?can bestow on a civilian ? at the White House in?February?2011.

    Hello there, and welcome to 2013 on my blog!

    I always take some time off over December to immerse myself in the kids and the traditions of Christmas?.it has been so nice. Over that time, we re-c0nnected with old friends and family, had a lot of rest, took the boys camping, celebrated two birthdays, organized a trip to Disneyland for Mckenna, organized a weekend with cousins for Anna, had everyone at our house for Christmas Eve, and hosted a NYE party turned hilarious tipsy dance party. I was also able to photograph newborn twins on New Years Day, and meet up for a last minute session with a repeat client at the beach. We ALSO cleaned out and re-organized our home office, which was a huge major undertaking.

    WHEW!

    I spoke here about wanting to make Christmas something ?. more ?. and less ?.. this season. With older kids, we wanted to make something magic out of our time together that didn?t have as much to do with Jolly Ole Saint Nick and the presents he brings. We still wanted to offer them gifts, but we wanted to limit the amount and gift with some meaning and thoughtfulness. It became a puzzle/challenge for us to think of things that were simple, yet would be fun or surprising for them to open. We did a name swap with my family to save money and limit stress for everyone. I wanted to focus on giving with the kids, and we came up with something we could give everyone: homemade succulent planters. I had a plethora of second hand containers and soil, all it took was a trip to Home Depot for a flat of baby plants and some time with the kids choosing which succulents would go to whom, and in what container. They loved creating them and giving them, as did I. I am pretty sure everyone liked receiving them, too.

    Another thing that was important for me to address was Christmas day itself ? it was going to be the first time in years we would stay home all day, just us, and I wanted to make sure it was special. Jeff and I talked many times about many different ideas. But the one that stuck is pictured above.

    These photos are from Christmas morning. We woke them up for a change, while it was still dark outside, at 5:45am. Jeff whispered, ?Get dressed in warm clothes, and head quietly downstairs, we have a surprise for you.? As they got ready, I made hot chocolate and coffee in paper to-go cups. We piled into our cold car, listening to Christmas music as we drove. The streets were empty. It was dark. We drove to one of our favorite spots and walked up to the top of a hill that has 365 degree views of Orange County. You can see ocean, mountains, and everything in between. I handed out our warm drinks, laid out a blanket, and we watched the Christmas morning sunrise.

    It was really, really special. I was overcome with emotion and joy in a way I haven?t been in a long time. I knew it was right, that it was needed, that they would get it. I had never woken up for a sunrise before in my life, and neither had the kids. We cuddled, drank our coffee and hot cocoa, took photos, and then when the sun had peeked above the mountains and the morning was all lit up, we drove home to see what Santa had left us.

    I am enthusiastically looking forward into 2013, which professionally will (finally) bring the change to my brand, new blog formats and features, more travel sessions, and a new collaboration I am really thrilled and excited to be a part of.     Personally, I hope 2013 will include more time with my favorite people, more learning and personal growth, more time outside, and duh ? obvi: more good thrift karma.

    Can Colorado make the health insurance exchange user friendly?

    A trio of public advocacy groups released findings from their focus groups and consumer surveys on what people want and need to effectively use the Colorado Health Benefits Exchange, the key portal for many uninsured under the Affordable Care Act.

    The portal needs to open this coming fall in order to have consumers signed up for insurance plans beginning Jan. 1, 2014. The exchange is where individuals and small businesses or nonprofits will learn about affordable (they hope) insurance plans, how they compare, and what it will cost after any available federal subsidies. To successfully draw in potentially hundreds of thousands of people who are currently uninsured, underinsured or simply unhappy with the plan they get through other means, the exchange must have a consumer friendly design and help people navigate a deeply complex system. It must welcome everyone from the extremely sharp and frustrated small business owner, to uninsured patients long out of the system who may have language issues, literacy issues or a general low tolerance for maneuvering in a bureaucracy.

    Some of the early work in designing a system falls to the Colorado Consumer Health Initiative, the Colorado Center on Law and Policy, and the Colorado Public Interest Research Group Foundation. They have been gatherings reactions, advice and demands, and on Monday released some of their findings.

    To me the most striking thing about today?s release is the graphic above about what people think they need on the site to help make their decisions. Under ?Consumer Exchange website needs,? the first suggestion is a TurboTax style interaction, and that seems exactly right: A smart web site would begin with a simple series of questions for the customer, and go deeper depending on the answers. If the customer can?t handle it by themselves, a trained navigator sits with them and goes through the questions: ?Do you currently have insurance? Are you single, or with a family? Will your employer offer insurance? Do you want dollar one coverage, or a high deductible? Do you want to use your current doctor, or is saving money more important? Are extra mental health benefits important to you? How much income do you expect next year?? And then, very soon, a calculation of how much federal tax subsidy will qualify for, and how much of their monthly income will be taken up by the proposed health policies.

    Everyone has seen bad software, at home or work, that requires you to be a programmer yourself to do routine tasks. The health exchange needs to keep thinking like TurboTax, or better yet, keep asking, ?WWSJD?? What would Steve Jobs do? Or have done? He would have kept it simple, and reminded everybody at every step of the process about the confused consumer sitting at the terminal on the other end of the Internet.

    Modern smartphones have a host of sensors on them; there are accelerometers, cameras, microphones, and the global positioning system (GPS). I?m not sure how I ever got anywhere before Google Maps.

    It?s not difficult to use Android?s GPS API in your own applications.?There are, however, a number of steps you must follow and a few guidelines to keep in mind. This tutorial will walk you through the most basic of GPS usage scenarios. You can follow along with the detailed instructions below or download and import the entire project into Eclipse.

    1. Create a new Android project in Eclipse. Target Android 1.6 or higher.?Be sure to rename the startup activity to Main.java and the corresponding layout to main.xml.

    2. Android provides several mechanisms for getting a user?s location; these mechanisms include network, passive, and GPS.?You can find a description of all three in the official Android documentation. For the purposes of this tutorial, we will only be using the GPS mechanism. Therefore, in the AndroidManifest.xml file, we will need to add a single permission for ACCESS_FINE_PERMISSION.

You need to keep this at a reasonable value or you will drain the phone battery very quickly.?For the purpose of the demo I used 60 seconds, but even that might be excessive in a live application.

    5. The on click listener is responsible for invoking the system menu to allow a user to enable or disable the GPS. This is needed because for security reasons an application cannot turn on the GPS without user interaction. If that sounds like a pain it is meant to be. While as a developer the idea of being able to toggle the GPS hardware on and off at will sounds nice, I am also an Android user, and I sure don?t want a rogue app running down my battery or worse uploading my location to a website for thieves alerting the world every time I leave my house.

    There, that wasn?t so bad, was it??Just remember the two golden rules: only a user can enable the GPS, and keep your location access to a minimum to preserve the battery.

    Pocket, the cross-platform bookmarking service formerly known as Read It Later, is now available to OS X?users. Like the browser extension and mobile apps, Pocket for Mac lets users save Web pages, video clips, and images to their accounts and access them at a later time.

    So why would you use Pocket for Mac desktop client instead of the browser-based Pocket? The tweaked user interface features an improved icon layout and, more importantly, you can access content without an Internet connection. Previously, the only way to view your saved clips was to log into the Pocket website. Pocket for Mac may prove a highly valuable tool if you're a frequent Web reader.

    Getting Started With Pocket
    You're prompted to sign into your Pocket account, or create one, after you launch Pocket for Mac. You then arrive at a screen that's vertically split into two portions. The left column is your List of saved content. The larger, right area is where Pocket display content. You're given two options after logging in: "Save From Browser" and "More Ways to Save."

    The former takes you to getpocket.com/add where you can install a Safari browser extension. Once the extension is installed, you can save any page to Pocket by clicking the Pocket icon located left of the browser's address bar. You can also add tags that should help you better organize content. The latter option displays the many ways you can save to Pocket via third-party apps (there are over 300 in total including the likes of Dolphin Browser HD?and Flipboard)

    The Pocket for Mac Experience
    Pocket for, regardless of which platform, pushes articles, images, and more to your Mac desktop. The pages, meme images, and other interesting online finds that I'd previously saved using mobile apps populated my Pocket for Mac library soon after I connected my Mac to Wi-Fi. Like the Pocket mobile apps, Pocket for Mac displays web pages (and video clips!) in a stripped down view that eliminates visual clutter and focuses on what's on hand. You can, of course, click an icon that lets you view full pages. However, video, unlike images and web pages, isn't available for offline playback. That may prove an irritant to the YouTube crowd, but you can watch your favorite saved clips when you take your Mac back online.

    'Zero Dark Thirty' torture controversy: Sony stands behind hit movie

    zero-dark-thirty-inaccurate.jpegAfter receiving five Oscar nominations this week, "Zero Dark Thirty" is on its way to topping the box office in its first weekend of wide release, but the film is still plagued by controversy over its depictions of torture.

    The Kathryn Bigelow film chronicles the CIA's efforts to hunt down Osama bin Laden and includes vivid depictions of "enhanced interrogation techniques" during the early stages of that process.

    The controversy has already sparked a Senate Intelligence Committee investigation into how screenwriter Mark Boal obtained his supposedly fact-based information. Both Bigelow and Boal spoke in defense of their film at the New York Film Critics Circle awards earlier this week.

    But that did little to quiet the conversation. On Wednesday, Academy of Motion Picture Arts and Sciences member David Clennon (an actor best known for TV's "thirtysomething") published an op-ed piece about his decision not to vote for the film in any categories.

    On Thursday, Bigelow was not among the 2013 Oscar nominees for Best Director, a surprise widely viewed as a snub. (The film was still nominated in key Best Picture, Best Actress and Best Original Screenplay categories.)

    Now Amy Pascal, co-chairman of the film's distributor Sony Pictures, released a statement addressing the controversy:

    "Zero Dark Thirty does not advocate torture. To not include that part of history would have been irresponsible and inaccurate.? We fully support Kathryn Bigelow and Mark Boal and stand behind this extraordinary movie.

    "We are outraged that any responsible member of the Academy would use their voting status in AMPAS as a platform to advance their own political agenda. This film should be judged? free of partisanship. To punish an Artist's right of expression is abhorrent.? This community, more than any other, should know how reprehensible that is. While we fully respect everyone's right to express their opinion, this activity is really an affront to the Academy and artistic creative freedom.

    "This attempt to censure one of the great films of our time should be opposed. As Kathryn Bigelow so appropriately said earlier this week, 'depiction is not endorsement, and if it was, no artist could ever portray inhumane practices; no author could ever write about them; and no filmmaker could ever delve into the knotty subjects of our time.'? We believe members of the Academy will judge the film on its true merits and will tune out the wrongful and misdirected rhetoric."

    Legal Status of the Trillion Dollar Coin | MyFDL

    There is a lot of loose talk out there about the legal status of the Trillion Dollar Coin idea. Let?s go to the statute books.

    Applicable Statutes

    31 USC ? 5111
    (a) The Secretary of the Treasury?
    (1) shall mint and issue coins described in section 5112 of this title in amounts the Secretary decides are necessary to meet the needs of the United States;
    (2) may prepare national medal dies and strike national and other medals if it does not interfere with regular minting operations but may not prepare private medal dies;
    (3) may prepare and distribute numismatic items;

    31 USC ? 5112
    (a) The Secretary of the Treasury may mint and issue only the following coins:
    (1) a dollar coin that is 1.043 inches in diameter.
    (2) a half dollar coin that is 1.205 inches in diameter and weighs 11.34 grams.
    (3) a quarter dollar coin that is 0.955 inch in diameter and weighs 5.67 grams.
    (4) a dime coin that is 0.705 inch in diameter and weighs 2.268 grams.
    (5) a 5-cent coin that is 0.835 inch in diameter and weighs 5 grams.
    (6) except as provided under subsection (c) of this section, a one-cent coin that is 0.75 inch in diameter and weighs 3.11 grams.
    (7) A fifty dollar gold coin that is 32.7 millimeters in diameter, weighs 33.931 grams, and contains one troy ounce of fine gold.
    (8) A twenty-five dollar gold coin that is 27.0 millimeters in diameter, weighs 16.966 grams, and contains one-half troy ounce of fine gold.
    (9) A ten dollar gold coin that is 22.0 millimeters in diameter, weighs 8.483 grams, and contains one-fourth troy ounce of fine gold.
    (10) A five dollar gold coin that is 16.5 millimeters in diameter, weighs 3.393 grams, and contains one-tenth troy ounce of fine gold.
    (11) A $50 gold coin that is of an appropriate size and thickness, as determined by the Secretary, weighs 1 ounce, and contains 99.99 percent pure gold.
    (12) A $25 coin of an appropriate size and thickness, as determined by the Secretary, that weighs 1 troy ounce and contains .9995 fine palladium.
    ?
    (k) The Secretary may mint and issue platinum bullion coins and proof platinum coins in accordance with such specifications, designs, varieties, quantities, denominations, and inscriptions as the Secretary, in the Secretary?s discretion, may prescribe from time to time.

    31 USCS ? 5103

    United States coins and currency (including Federal reserve notes and circulating notes of Federal reserve banks and national banks) are legal tender for all debts, public charges, taxes, and dues. Foreign gold or silver coins are not legal tender for debts.

    Legislative History, Such As It Is, and Plain Language

    Section (k) Was Added In By P.L. 104 ? 208, the 1997 Omnibus Consolidated Appropriations Act. The provision isn?t discussed in the House Report or the Senate Report as best I can tell. The statute adds several provisions besides section (k) related to commemorative coins, which generally are regarded as numismatic or collectible coins as opposed to circulating coins. The point of those sections is to enable the Treasury to make a significant seigniorage profit on these coins, and to raise money to assist in worthy causes. There are numerical limits on certain of the coins, as in section (m), presumably to protect their numismatic value, although the Secretary of the Treasury is authorized to make more if there is sufficient demand. There is no similar limitation on issuance of platinum coins. In any case, all coins are legal tender, whether they are numismatic or intended for circulation.

    In a similar way, the Treasury is authorized to print U.S. currency notes itself, but the amount is limited to $300 million. 31 USCS ? 5115.

    Section 5111 authorizes the Secretary of the Treasury to mint and issue coins as described in ? 5112 in such amounts as the Secretary decides are necessary to meet the needs of the United States. This is very broad language, and does not appear to establish any limitation on the factors that might help the Secretary determine the needs of the United States.

    Of course, our conservative Supreme Court Justices aren?t interested in legislative history (except when it suits them). They rely on the plain language of the law. It would be a real hoot to watch Justice Scalia explain why the plain language is not plain enough for him.

    The Debt Ceiling

    The debt ceiling statute, 31 USC ? 3101 sets a maximum amount of money that the Treasury can borrow. Currently, the amount is $14.294 trillion. That section is modified by 31 USC ? 3101A, which allows the President to increase the borrowings by an additional $2.1 trillion subject to approval after the fact by Congress. Between the two sections, the limit is currently $16.394 trillion. The Treasury has determined that the limit has been reached, and is currently operating in an emergency fashion to avoid issuing more debt.

    Constitutional Issues

    There are several applicable provisions of the Constitution and statutory law that are implicated by this problem. Two law professors, Neil Buchanan of The George Washington University Law School and Michael Dorf of Cornell University Law School have written articles discussing the problem. How to Choose the Least Unconstitutional Option: Lessons for the President (and Others) from the Debt Ceiling Standoff, 112 Colum. L. Rev. 1175 (2012), and Nullifying The Debt Ceiling Threat Once And For All: Why The President Should Embrace The Least Unconstitutional Option, 112 Colum.L. Rev. Sidebar 237 (2012). Nullifying is available here. The authors describe the problem as a

    ? trilemma?: faced with the constitutional duty to execute the spending laws that Congress enacted, to collect tax revenues under the laws that Congress enacted, and to borrow no more than the amount of gross debt specified in the debt ceiling statute, the president would have to violate at least one of those laws when the debt ceiling is reached. In thus violating his oath to faithfully execute the laws?all of the laws?of the United States, he would be acting unconstitutionally. The only question was which unconstitutional choice would be least unconstitutional.

    Id. at 239, fn omitted. In How to Choose, the authors conclude that the least serious violation of the Constitutional duty to enforce the laws would be to continue to issue debt. Their explanation is that Congress can fix the problem whenever it chooses, either by increasing the debt ceiling, or by increasing tax revenues or by cutting spending, or some combination. They point out that the problem was created by Congress, which enacted a continuing resolution on taxing and spending that practically insured that the debt ceiling would be reached sometime in 2013.

    The authors note that the President has rejected the 14th Amendment solution, so they assume that the President has decided that he is required to spend less than that which Congress has required him to spend. That would, of course, violate the Impoundment Control Act of 1974, which requires the President to spend the money authorized by Congress in accordance with its instructions. Furthermore, there are two Supreme Court cases holding that the President has the Constitutional duty to comply with the spending directions of Congress. Train v. City of New York, 420 US 35 (1975) and Clinton v. City of New York, 524 US 417 (1998). The authors explain that these decisions are rooted in separation of powers, the fundamental principle of our government that each branch of government has specific powers denied to the others. The Congress has the power of the purse. The President can veto an appropriations bill, or a tax bill, but he cannot refuse to spend some of the money authorized by a spending bill, because that would give him an unbalanced veto in direct contravention of the Constitution.

    Bmaz at Emptywheel makes a potent argument about the separation of powers inherent in the Trillion Dollar Coin. He doesn?t, however, deal with the separation of powers argument inherent in refusing to comply with spending directions of Congress. Bmaz might respond that the President is not refusing to spend the money, he is merely not doing it until he feels he has no choice. Still, assuming that Congress doesn?t act quickly on the matter, the problem becomes intractable almost immediately. Almost all payments are done by computer, not by check. How can short term stoppage of payments be managed without changing computer systems across the government? How is that to be paid for? Can Congress create a separation of powers problem for another branch of government and then use that problem to punish that branch? Can Congress abuse the separation of powers to the detriment of the entire nation?

    The Trillion Dollar Coin as a Solution

    The law professors dismiss the Trillion Dollar Coin as ?cartoonish and desperate?, and state that it would ?likely spook the markets, leading lenders to demand a very high interest rate?. How to Choose, at 1231. Those interest rate fears are common among a certain group of people, but so far they haven?t been realized. In any event, the same argument can be made for Treasury Obligations created in excess of the statutory debt ceiling, which is their solution.

    Everyone agrees that this is a bad situation. What is the least bad alternative? Bmaz says the least bad alternative is the chaos of a government shutdown. Suppose the Secretary of the Treasury disagreed. Suppose he thought that the damage to the economy would be overwhelming. Would that justify him in issuing millions of quarters or $50 gold pieces and sending them to the Fed for deposit in the Treasury account? Again, the only statutory factor governing the determination of the Secretary is the ?needs of the United States?. Would the law professors regard the minting of $50 gold pieces as cartoonish and desperate? Would bmaz suggest that it violated the separation of powers? If not, then why not the Trillion Dollar Coin?
