Google Search app for iOS updated with new voice search functionality, iPhone 5 compatibility

Google just released an updated version of its Search app for Android devices yesterday, and it's now (as promised) also delivered a fairly big update to iOS users. That brings with it iPhone 5 compatibility, but the bigger news is the expanded voice search functionality, which promises "faster and significantly improved voice recognition," with spoken responses à la Google Now provided alongside the search results. Those additions also extend to iPad users in addition to the iPhone and iPod touch -- hit the App Store or the link below to take it for a spin yourself.

Dutch court says Samsung does not infringe Apple patent

AMSTERDAM (Reuters) - A Dutch court has ruled Samsung Electronics does not infringe an Apple Inc patent by using certain multi-touch techniques on some of the Samsung Galaxy smartphones and tablet computers.

Samsung and Apple, the world's top two smartphone makers, are locked in patent disputes in at least 10 countries as they vie to dominate the lucrative mobile market and win over customers with their latest gadgets.

Apple scored a sweeping legal victory over its South Korean rival in August when a U.S. jury found Samsung had copied critical features of the hugely popular iPhone and iPad and awarded Apple $1.05 billion in damages.

But a judge has not yet ruled on Apple's request to permanently ban some of Samsung's products from the U.S. market, and the U.S. company has also faced some setbacks.

Apple argued in September in the Hague court that Samsung infringed its patent on multi-touch function, which lets users use two fingers at one time on a touch screen.

"With these products Samsung does not infringe the claims that Apple has made," the court said in its ruling on Wednesday.

Apple has taken Samsung and others to court over the "pinch to zoom" function popular on smartphones and tablets.

Apple lost a preliminary injunction on this patent in the Dutch courts last year and also lost its battle in the courts in Britain against HTC Corp, and in Germany against Samsung and Motorola Mobility, which is owned by Google.

The Dutch court acknowledged that its multi-touch patent ruling was similar to those in Britain and Germany.

Samsung said it welcomed the Dutch court's decision, while Apple declined to comment on the ruling.

The Hague has become an important court room battle ground between companies making mobile phones and tablet computers, as court actions there are considered to be cheap, speedy and efficient.

The Dutch court's ruling comes ahead of a decision in the United States from the International Trade Commission on Thursday over claims that Samsung infringed on Apple patents.

Bill Gates Talks Windows Future, Touch Interfaces (Slashdot)

Apple borrowing from BSD was a brilliant move. OS9 (the predecessor to OSX) was absolutely horrible. Slow, prone to crashing, and it ran on PowerPC chips that were far slower than Intel chips. When Apple brought Jobs back it was partly because of the operating system that NeXT had developed that was based on BSD. It evolved into what is now OSX.

Apple did not invent BSD or Linux or UNIX but what they did do was take a very stable, open source, version of UNIX (BSD) and put a beautifully appealing graphical front end on it (AQUA). I would argue that OSX is the most user friendly version of any UNIX or Linux based kernel. It's very stable, it's easy to use and it looks nice. I would bet that a lot of Mac users don't even know, or care, that it's based on UNIX. They just know that it works and is enjoyable to use.

Apple hasn't invented a lot of things but they have taken what others have done and made it better. That's innovation. In the same way that Android looks and works very much like IOS. In the same way that nearly every modern smartphone uses a touch interface. Apple didn't invent the touch interface either, they just perfected it. Some people think that Microsoft "stole" the GUI from Apple, who in turn "stole" it from XEROX. Who knows?

In my view, none of that stuff is stealing. It's simply the industry realizing that there is a better way to do things and then everyone embraces it. Balmer and Gates have seen the writing on the wall. PC sales are down drastically. For many people, particularly in developing countries, a smartphone is their first and only internet enabled device. That's where the growth is. So Windows is going to have to evolve if it wants to stay relevant in the consumer space. Time will tell how successful it is.

Quantum computing with recycled particles

ScienceDaily (Oct. 23, 2012) ? A research team from the University of Bristol's Centre for Quantum Photonics (CQP) have brought the reality of a quantum computer one step closer by experimentally demonstrating a technique for significantly reducing the physical resources required for quantum factoring.

The team have shown how it is possible to recycle the particles inside a quantum computer, so that quantum factoring can be achieved with only one third of the particles originally required. The research is published in the latest issue of Nature Photonics.

Using photons as the particles, the Bristol team constructed a quantum optical circuit that recycled one of the photons to set a new record for factoring 21 with a quantum algorithm -- all previous demonstrations have factored 15.

Dr Anthony Laing, who led the project, said: "Quantum computers promise to harness the counterintuitive laws of quantum mechanics to perform calculations that are forever out of reach of conventional classical computers. Realising such a device is one of the great technological challenges of the century."

While scientists and mathematicians are still trying to understand the full range of capabilities of quantum computers, the current driving application is the hard problem of factoring large numbers. The best classical computers can run for the lifetime of the universe, searching for the factors of a large number, yet still be unsuccessful.

In fact, Internet cryptographic protocols are based on this exponential overhead in computational time: if a third party wants to spy on your emails, they will need to solve a hard factoring problem first. A quantum computer, on the other hand, is capable of efficiently factoring large numbers, but the physical resources required mean that constructing such a device is highly challenging.

CQP PhD student Enrique Mart?n-L?pez, who performed the experiment, said: "While it will clearly be some time before emails can be hacked with a quantum computer, this proof of principle experiment paves the way for larger implementations of quantum algorithms by using particle recycling."

It's Not You, Android - It's Your Apps

A substantial number of apps available from Google Play had serious flaws in their Secure Sockets Layer implementations and thus were vulnerable to hack attacks, European researchers found. The team downloaded 13,500 popular free apps to study their use of the SSL or Transport Layer Security protocols, with a particular focus on the apps' vulnerabilities against Man-in-the-Middle attacks.

Jewish group condemns Egypt's president

CAIRO (AP) ? The Simon Wiesenthal Center, which monitors anti-Semitic incidents worldwide, has made a strong condemnation of Egypt's new President Mohammed Morsi of the Muslim Brotherhood, after he attended a sermon where the preacher called for the "destruction and dispersal of the Jews."

A video emailed by the center showed Morsi at a mosque in the Mediterranean town of Marsa Matruh, where the congregation answers "Amen" to a cleric who recites a list of prayers in a traditional ritual.

In one of the prayers, the cleric asked God to "destroy the Jews and their supporters and disperse them, rend them asunder." Morsi is then seen continuing to say Amen. The prayers were aired on state TV and caught on video by MEMRI, a pro-Israel media monitoring group.

In a statement, the Wiesenthal Center strongly condemned the video, saying it is a sign of growing anti-Semitism in Egypt.

"This is a slap in the face to America as Egypt's President Morsi pockets billions in U.S. aid and says Amen to principles that are repugnant to all Americans," the statement said, quoting Rabbi Marvin Hier, dean and founder of the Wiesenthal Center, and Rabbi Abraham Cooper, the Center's associate dean.

The center called for President Barack Obama to condemn "the growing chorus of anti-Semitism in Egypt, led by the Muslim Brotherhood" and to cut contacts with the group.

Morsi's office was not immediately available for comment.

It is the second statement on Egypt this month by the center, which earlier condemned comments made by the Brotherhood's leader, Mohammed Badie, who said that Jews were spreading "corruption," had slaughtered Muslims, and desecrated holy sites. He also called on Muslims to fight Israel, saying Zionists only understood force.

Prayers denouncing Israel or the Jews ? two terms often used interchangeably in Arab countries ? are not uncommon in hardline sermons, which were not a regular feature on state TV before the ouster of former President Hosni Mubarak.

Since taking office, Morsi has refused to meet with Israeli officials, or even use the word Israel in public statements. But his government has continued security cooperation with the Jewish state and says Egypt will continue to abide by the peace treaty signed between the two countries in 1979.

Last week, however, Morsi faced a chorus of angry critics when it emerged that the new Egyptian ambassador to Israel carried an endorsement letter signed in Morsi's name that referred to Israeli President Shimon Peres as "great friend."

Many of Egypt's revolutionary groups and prominent opposition figures criticized Morsi for calling his Israeli counterpart a "friend." Some demanded an explanation for the discrepancy between his group's public stance against Israel and the diplomatic note.

One former supporter of Morsi, prominent left-leaning TV personality Hamdy Kandil, subsequently quit a group supporting the president, citing the letter as one of the reasons. "Morsi must explain to us how his friendship was strengthened with his great friend," Kandil wrote on his Twitter account.

LG India confirms its worst-kept secret, Nexus 4 to be announced Oct. 29

Android Central

The LG Nexus 4 has been extensively leaked over the past few weeks. We've seen the front, back, sides and even taken a sneaky peek at the phone's internals. Nevertheless, the phone is still officially unannounced, pending a Google event in New York City on Oct. 29.

Today LG's broken its silence on the device, according to reports from Indian news site IBNLive. The site reports that Amit Gujral, Head of Mobile Product Planning for LG India confirmed the device's existence in an interview at an Optimus Vu launch event. "Google will unveil the LG Nexus on October 29 and the phone will be available in the Indian markets by the end of November," Gurjal is reported as saying. He also apparently spilled the beans on the device's hardware, confirming reports of a 4.7-inch display, a 1.5GHz quad-core CPU (presumably a Snapdragon S4) and Android 4.2.

The "LG Nexus," as Gurjal calls it, will be available in India by the end of November, following an unveiling by Google on Oct. 29. That means other territories will likely get the device even earlier in the month. We're not sure this official confirmation was supposed to slip through the net, but in any case, it's one more piece of the 2012 Nexus puzzle. We'll be live from New York City next Tuesday to bring you all the Nexus announcements as they happen!

No comments - Special Education Law Blog - Yes

Our series providing an introduction to special education law continues.? Previous posts have introduced the two basic concepts underlying IDEA, free and appropriate education and least restrictive environment.? Last week we discussed eligibility and identification.? Today we will look at selected IEP issues.

Some IEP Issuies

Issues pertaining to IEPS are among the most frequent to appear in due process hearings.? Here are some fundamental points:

Issues pertaining to individualized education programs are governed by IDEA ?? 612(a)(4) and 614 (d)-(f).? See, 34 C.F.R, ?? 300.320-300.323, ?300.324 ? 300.328.

L.B. & J.B. on behalf of K.B. v. Nebo Sch. Dist., Bd. of Educ., et al, 379 F.3d 966, 41 IDELR 206 (10th Cir. 8/11/2004).? The IEP is the basic mechanism through which each child?s individual goals are achieved.?

D.F. & D.F. ex rel N.F. v. Ramapo Cent. Sch. Dist. 105 LRP 57524 (2d Cir. 11/23/05).? The Court notes that the case raises an issue as to whether it is proper to utilize prospective or retrospective analysis of an IEP.? The court stated that an IEP is a snapshot not a retrospective. In striving for appropriateness, an IEP must take into account what was, and was not, objectively reasonable when the snapshot was taken, i.e., at the time the IEP was formulated.? Contrast, ?MS by Simchick v. Fairfax County Sch Bd 553 F.3d 315, 51 IDELR 148 (4th Cir 1/14/09).

?

In a recent trend involving cases alleging failure to implement IEPs, courts have increasingly taken a stance that to be actionable, the failure to implement must have been "material." This trend follows the reasoning of the Ninth Circuit Court of Appeals in? Van Duyn ex rel Van Duyn v. Baker Sch Dist 5J 481 F.3d 770, 47 IDELR 182 (9th Cir. 4/3/7)?

(AP) ? The NHL's next cuts will be the deepest and most costly.

With only days remaining to make a deal with the players' association on a new collective bargaining agreement that will allow for a full hockey season, the NHL canceled another week of games Friday.

A day after the NHL turned down three counterproposals from players, the league wiped out 53 more games. A total of 135 games through Nov. 1 have been scratched, which amounts to 11 percent of the season.

"As expected," New York Rangers goalie Martin Biron told The Associated Press in a text message. "We continue to work hard to find an agreement and get back to playing hockey."

These lost games could still become mere postponements. If a new contract is reached with the union by Thursday, the NHL will be able to get the season under way on Nov. 2, and each team will play all 82 games after a weeklong training camp.

However, a quick settlement to end the lockout sure seems like a longshot. Without a new deal, more games will be eliminated along with the hope of playing a full season.

In its third lockout since 1994, the NHL is sticking to its most recent proposal that stated an 82-game-per-team schedule could be played if the season begins by Nov. 2. Two weeks ago, the league called off 82 games from Oct. 11-24.

On Thursday, the union rejected the NHL's proposal made two days earlier that offered a 50-50 split of hockey-related revenues and ensured a full regular-season schedule. In brief talks, the players countered with a trio of offers that were, in turn, quickly dismissed by the league.

"We are disappointed that the NHL has canceled more games as a result of the owners' lockout," said former player Mathieu Schneider, now the NHLPA special assistant to the executive director. "The players made another major move in the negotiations this week in an effort to end the lockout, by presenting the owners with a proposal that gets to a 50-50 split of revenues.

"In return, we expect that owners will honor the current contracts they have already signed, which everyone knows is fair."

NHL Commissioner Gary Bettman said he was "thoroughly disappointed" as he and the league delegation left union headquarters in Toronto on Thursday. Bettman said that the owners' proposal was the "best that we could do" and added that the sides are still far apart.

"None of the three variations of player share that they gave us even began to approach 50-50, either at all or for some long period of time," Bettman said. "It's clear we're not speaking the same language."

No new talks are scheduled.

If next Thursday's deadline passes, more games will likely be cut and the New Year's Day Winter Classic will be the next big event in danger of being lost. The Detroit Red Wings are slated to host the Toronto Maple Leafs in the outdoor extravaganza at Michigan Stadium.

Union executive director Donald Fehr said two of the union's proposals would have the players take a fixed amount of revenue, which would turn into an approximate 50-50 split over the term of the deal, provided league revenues continued to grow.

The third approach would be a 50-50 split, as long as the league honored all existing contracts at full value.

None of it made any positive impression on the NHL.

"This is not a good day," Fehr said Thursday. "It should have been."

This is nothing new in the world of hockey. A lockout eight years ago caused the cancellation of the entire 2004-05 season, marking the only time a North American sports league lost a full year to a labor dispute.

Norfolk State Loses First Conference Game of the Season

Norfolk State lost to Bethune-Cookman 14-6 last Thursday night in an HBCU showdown aired on ESPNU.

The Spartans (6-2, 4-1 MEAC), who are near the top of the conference in offense, struggled against the Wildcat defense.

Bethune took a 7-0 lead on an Anthony Jordan two-yard touchdown run. Everett Goldberg made a 50-yard field goal with 2:18 remaining in the second quarter to give NSU its first points of the game.

Bethune led 7-3 at halftime.

The Wildcats opened the third quarter with an eight-play, 70-yard drive, capped by a seven-yard touchdown pass by Jackie Wilson to lead 14-3 with 14:55 remaining. The Spartans added another field goal late in the quarter to cut the deficit to eight (14-6).

BCU's Dion Hanks intercepted a Chris Walley pass with under a minute left in the game to seal the win for the Wildcats.

The loss snaps a five-game win streak for the Spartans and gives them their first conference loss of the season.

Isidore Jackson ran for 206 yards on 34 carries for Bethune-Cookman (4-3, 2-2 MEAC).

Howard Upsets NC A&T in Overtime

Howard defeated North Carolina A&T in overtime 35-28 last Saturday in Washington, D.C.

The Bison controlled the first half, leading 13-0, which included two field goals by kicker Parker Munoz. All of A&T's first half drives ended with a turnover on downs, a fumble and two punts.

Howard (4-4, 3-2 MEAC) led at halftime by the same score.

The Aggies (4-3, 3-1 MEAC) overcame the halftime deficit with two touchdowns, including a 20-yard touchdown pass by Lewis Kindle to lead 14-13 heading into the fourth quarter.

Both teams scored two touchdowns apiece in the final period, including a 66-yard run by Mike Mayhew and an 82-yard kickoff return by Howard's Aquanius Freeman. Neither team scored in the remainder of the game and the score was tied at 28 going into overtime.

Terrence Leffall gave Howard a 35-28 lead in the extra period with a three-yard touchdown run. The Aggies converted two first downs on its first overtime possession to reach the Howard three-yard line.

A&T was faced with a fourth and four after a Mayhew one yard loss, and Kindle was stopped short by defensive end Sackie Kerkulah, preserving the upset win for the Bison.

The loss denied the Aggies the opportunity to move into sole possession of first place in the conference after Norfolk State lost last Thursday to Bethune-Cookman.

Kindle passed for 162 yards, a touchdown and an interception for the Aggies.

Florida A&M Rallies in Fourth to Upend SC State

Florida A&M defeated South Carolina State 27-24 last Saturday afternoon in another wild MEAC contest.

The Rattlers trailed by as much as 11 in the second quarter before scoring on a Damien Fleming six-yard touchdown pass with 1:16 left to cut the Bulldogs' lead to four (17-13). SC State led at halftime with the same score.

FAMU rallied in the fourth behind Lavante Page's two rushing touchdowns to lead 27-24 with 2:31 remaining.

SC State was then stopped on a four-and-out and the Rattlers ran out the clock on the game's final possession with three consecutive runs by Page.

Boxers, not briefs, for Abercrombie jet stewards

Benoit Tessier / Reuters

No dress code for the models, though. A discrimination lawsuit bares some of the dress requirements for stewards on the private jet of Abercrombie & Fitch CEO Michael Jeffries, including boxer briefs and A&F cologne.

By Martha C. White, NBC News contributor

The jet-setting eccentricities of Michael Jeffries have been?laid bare in a discrimination lawsuit filing, exposing the Abercrombie & Fitch Co. CEO?s exacting dress code for the flight attendant-slash-models that accompanied him on his Gulfstream jet.

The idea that flight attendants have to have a certain, attractive ?look? seems as outdated as go-go boots, but Jeffries ? who turned Abercrombie into a hot teen brand?by sexing up the image of the all-American jock ? had 40-plus pages of rules flight attendants were expected to follow. That's?according to court documents filed in August in the Eastern District U.S. Court in Philadelphia by?55-year-old private jet pilot Michael Stephen Bustin, who filed suit in 2010 claiming he was fired because of his age.

The flight standards manual stipulated an incongruously strict uniform of jeans worn "at the hip," polo shirts and flip-flops. Sweatshirts could be worn, but only if the staff all coordinated their wardrobes.

A winter coat was required if the temperature fell below 50 degrees. The collar had to be turned up and the bottom button left unbuttoned. Hats were mandated when the temperature dropped below 40 degrees, with the brim folded two inches. Regardless of the weather, flip-flops had to be worn while flying and greeting passengers. Also mandatory for male attendants: boxer briefs and Abercrombie cologne "spritzed" over their uniforms

The court filings detail other offbeat demands of the CEO: Jeffries? three dogs had specific in-flight seat assignments and requests had to be acknowledged with the phrase, ?No problem." One part of the instructions on how to prepare and present Abercrombie sales reports included the directive,?"Bring Michael's lucky wallet to him."?

The company declined to comment.

Before the recession, Abercrombie & Fitch was known for its high-flying numbers, but the teen apparel retailer has hit turbulence as lower-priced brands like American Eagle Outfitters muscled in on its turf.

?The second quarter results we are reporting today are disappointing and below our expectations coming into the quarter,? Jeffries told investors on Abercrombie?s third-quarter earnings call in August, when the company reported that same-store sales fell 10 percent year-over-year.

Tip of the hat to Bloomberg, which reported on the lawsuit earlier.

Tool Review: Hyde PivotJet Pro

Hyde PivotJet Pro

Hyde PivotJet Pro--small, rugged, versatile.

This tool review is something of a first for me.

When I review a tool, I like to use the tool in most of its hero functions?cutting, drilling, driving, measuring, whatever. But the Hyde PivotJet Pro poses an unusual problem. So after using the Hyde PivotJet Pro pivoting nozzle wand along with my garden hose, it?s increasingly clear that getting to all the hero functions of the tool will take a really, really long time. While I admit that I?ve just scratched the surface, but I?m confident that this tool has proved a vast improvement and time saver everywhere I have taken it to task.

The PivotJet Pro is an adjustable, pivoting nozzle that attaches to a standard garden hose and can be used for a vast array of watering and cleaning jobs around the house and on the jobsite. Because the spray pattern is adjustable from mist to power stream you can use the PivotJet just about anywhere you?d use water but easier and faster.

I?ve used the PivotJet Pro watering freshly seeded grass in a lawn repair and watering established flowers. I?ve used it cleaning the underside of my lawnmower deck?and to clean the residual grass clumps left over on the sidewalk that I couldn?t scoop up with my shovel. A mangy household trashcan and recycling pail full of all kinds of icky-ness proved no match for the PivotJet nor did spraying clumped leaves from the nooks and crannies of our playset. I even used it spraying porch furniture and cleaning up sidewalk chalk.

One of the design features that makes all this possible is the adjustable spray pattern: I can put as much water?with the right amount of velocity, from a little to a lot?where I need it. Fan-spray for new grass; powerstream for lawnmower deck, and somewhere in-between for trashcans and furniture. And, unlike a typical nozzle with a fixed head, this one pivots 135 degrees. That means, for example, when cleaning the lawnmower (tip: let your lawnmower cool down first if you decide to clean right after mowing, then tip it on its side) is that instead of crouching to get all the areas under the deck?and getting sprayed in the face while doing so?I can just pivot the nozzle-head and keep working. Ditto for the trash can and the recycling pail.

Lexi Using Hyde's PivotJet Pro.

11-year-old Lexi using Hyde's PivotJet Pro for a lawn repair.

For cleaning cars or patio furniture, the PivotJet Pro has a soap dispenser in which you pour concentrated soap: Pine-Sol, Simple Green, etc. What?s also really smart is that if you switch from washing the car to watering flowers near the car, you can operate the unit with or without soap by adjusting the Mix Lever. Awesome. Zero down-time.

For the jobsite, the PivotJet pro is a real go-to?and something you can carry in your truck or van, unlike a full-dress pressure washer which I never keep in my truck. Deck projects, additions, fences, landscaping installs or repairs and other projects that involve site work when, mixed with rain, almost always result in muddy driveways and sidewalks from footprints, wheelbarrows and truck or equipment tires. Putting the PivotJet to work blasting through end-of-day mud is a no-brainer.

Finally, if you need to flood something with, say a firefighter type nozzle, the Hyde spray tip screws off and you can add standard garden hose accessories which can be good for anything from gushing through leaves in a clogged downspout to watering established grass and plants to watering the root balls of new plants. Heck, if you play your cards right, you can even shoot UP a downspout to loosen a clog.

Around the house or on the job, when I run out of uses or time saved using for the PivotJet Pro, I?ll let you know. Note: it might be a long wait.

NY Senate Candidates Answer 'Fifty Shades of Grey' Debate Question

There was one question Sen. Kirsten Gillibrand and Republican challenger Wendy Long hadn't prepared for during their Wednesday night debate in New York.

"Have you read 'Fifty Shades of Grey'?"

Both women hastily answered "no" when the question was posed during the lightning round of their only debate of the election and the room erupted in chuckles and some applause at Skidmore College in Saratoga Springs.

Long said she went along with the joke but was unamused.

"Frankly, I thought it was just completely bizarre," Long told ABC News. "I was trying to be a good sport and everyone was laughing. But I thought it was completely bizarre and sort of sexist."

As for Democrat Gillibrand, spokesman Glen Caplin said, "The only thing she found offensive last night was her opponent's views that women shouldn't have the freedom to make medical choices for themselves."

The erotic novel, which is part of a series by British author E.L. James, has taken literary culture by storm, selling 50 million copies worldwide and landing on the bedside table of millions of women in the process.

The debate between Gillibrand and Long was moderated by "Capitol Tonight" host Liz Benjamin and NY1 host Errol Lewis. Benjamin posed the question to the candidates during the debate's "lightning round" segment in which the candidates were asked a series of yes-or-no questions.

Benjamin said the lightning round and the "Fifty Shades" question were intended to lighten up an otherwise "tense" debate and to give the candidates a break.

"That book is a cultural phenomenon, got a lot of attention, a lot of eyeballs. So it seemed a pretty apropos question related to current events," Benjamin told ABC News after the debate. "Also, with all the attention on women this cycle, and two women candidates and a woman moderator, it worked."

On "The View" in May, even President Obama was asked to name the "controversial sex book that's on millions of women's bedside tables."

"I don't know that," Obama said. "I'll ask Michelle when I get home. ? I'll ask Michelle when I get home what's going on."

Still, Long says she thought the question distracted from an otherwise serious debate, and doubts that a question like that would come up in a debate if the candidates were men.

"There's no way that question would have been asked if it was a man and a woman debating," she said.
